VISITOR TERMS AND CONDITIONS – STICHTING FRANS HALS MUSEUM
1. GENERAL PROVISIONS: DEFINITIONS
1.1 Frans Hals Museum: a museum located at Groot Heiligland 62, Haarlem, the Netherlands, which, pursuant to its objects, makes the life and works of Frans Hals, as well as other works of art from his time period, accessible to as many people as possible in order to enrich and inspire them.
Frans Hals Museum, Location HAL: a museum located at Grote Markt 16, Haarlem, the Netherlands, which displays the Stichting Frans Hals Museum’s collection of modern and contemporary art.
1.2 The building: the areas of Frans Hals Museum at Groot Heiligland 62 and Frans Hals Museum, Location HAL at Grote Markt 16 that are accessible to the public. This includes developed and undeveloped spaces under the legal and managerial care of the management, including, but not limited to, exhibition spaces, auditoriums, conference rooms, restaurant, break room, patio, garden, park and other outdoor spaces.
1.3 Visitor: anyone entering the Frans Hals Museum or the Frans Hals Museum, Location HAL for the purpose of viewing an exhibition or attending, by invitation, a reception, conference, lecture or similar event held at Frans Hals Museum or Frans Hals Museum, Location HAL.
1.4 Entrance ticket: a ticket that grants a visitor access to the exhibition areas of the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL during opening hours.
1.5 Admission ticket: an entrance ticket (which may be in combination with a discount pass) or a similar document (e.g., a written invitation, a voucher or an annual pass) that grants access to (specified) areas of the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL.
1.6 Goods: all goods, including monies, monetary values and papers of value.
1.7 Officials of the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL: all natural persons who work in and around the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL by order of the Stichting Frans Hals Museum.
2. APPLICABILITY
2.1 These terms and conditions apply to all visitors of the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL, as well as all natural persons or legal entities presently or previously employed by Stichting Frans Hals Museum pursuant to its object.
2.2 These terms and conditions also apply to special events outside of regular opening hours and/or aimed at persons other than regular visitors, in the event of exclusive gatherings.
2.3 Deviations from these terms and conditions are valid only when expressly agreed in writing.
3. ACCESS TO THE FRANS HALS MUSEUM (GROOT HEILIGLAND) AND THE FRANS HALS MUSEUM, LOCATION HAL
3.1 Visitors are permitted to enter the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL only upon presentation of a valid admission ticket.
3.2 Visitors are refused (further) entry to the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL if their admission ticket was not issued by the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL or an organisation authorised by the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL to issue admission tickets.
3.3 Visitors must show their admission ticket to officials of the Stichting Frans Hals Museum at first request. Failure to do so means that Stichting Frans Hals Museum may deny the visitor entry to the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL.
3.4 Visitors will not receive a refund of the cost of admission in the event that the admission ticket or entrance ticket is lost or stolen before the visitor enters the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL.
3.5 A pre-sold entrance ticket will become void after the time specified on the entrance ticket.
3.6 Admission tickets and/or entrance tickets cannot be exchanged.
3.7 Stichting Frans Hals Museum is entitled to adjust its regular opening hours to account for incidental training of Emergency Response Officers in accordance with Article 23 of the Arbeidsomstandighedenwet (Netherlands Working Conditions Act) or, in the event of a genuine incident, for a complete or partial evacuation of the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL, if deemed necessary. Such adjustment of regular opening hours does not entitle the visitor to a refund of any admission fees paid.
4. VISITS TO THE FRANS HALS MUSEUM (GROOT HEILIGLAND) AND THE FRANS HALS MUSEUM, LOCATION HAL
4.1 Visits to the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL are at the visitor’s own expense and risk.
4.2 During their visit to the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL, visitors must conduct themselves in accordance with safety regulations, public order and other rules concerning their visit to the museum. Visitors must immediately follow instructions given by the clearly identifiable officials of the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL. If these officials find that a visitor is in breach of these terms and conditions or any standards or instructions, they may refuse them further entry to the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL without the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL being liable to pay damages of any kind.
4.3 Bags, backpacks, umbrellas, baby carriers worn on the back, prams (excluding pushchairs) and the carrying of other large objects are all prohibited. Objects up to A4 (letter-paper) size that cannot be unfolded must be stored in the cloakroom. The Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL may refuse to store larger objects. The Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL will accept no liability for damage to or loss of goods handed over for storage.
4.4 Visitors are liable for damage caused by any object taken into the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL in breach of the provisions of paragraph 4.3.
4.5 The Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL are entitled to permanently or temporarily refuse to admit to the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL any visitor who, during one or more previous visits to the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL or to another museum, damaged an object through negligence, gross negligence or an intentional act or omission, or if there is a justifiable concern that the visitor will cause damage. Each time such a visitor attempts to access the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL, the museums may subject them to the measures set out in paragraph 4.6. The visitor will be immediately notified of the decision to refuse entry, in writing if possible.
4.6 In the event of an emergency, e.g., the sudden disappearance of a work of art, a terrorist attack or any other type of violence, the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL are entitled to close the doors and to guide visitors out one by one. Visitors may be asked to cooperate while staff of the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL, or others acting on behalf of the staff, inspect their bags and other items. Visitors may also be asked to consent to a body search. Visitors refusing to cooperate with such inspection and/or search will be requested to furnish proof of identity before being allowed to leave the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL.
5. CODE OF CONDUCT
5.1 Visitors to the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL will refrain from the following:
a. Offering goods of any kind for sale or providing them free of charge to third parties.
b. Disturbing other visitors, including, but not limited to, obstructing their view of exhibited objects for an extended period of time or causing noise nuisance (including the use of mobile phones or other sound equipment).
c. Bringing domestic or other animals with them except where animals are expressly permitted or where guide dogs (for the blind) are concerned.
d. Smoking.
e. Consuming food or beverages except in the café/restaurant.
f. Touching exhibits, unless expressly and explicitly permitted. Parents, teachers and other supervisors must strictly monitor to ensure that the minors, individuals or groups they are accompanying refrain from touching the exhibits. Children under the age of 12 may visit the museum only under adult supervision.
g. Taking photographs or making video or film recordings without the prior written consent of the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL.
h. Drawing or painting without the prior written consent of the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL. Visitors should ask at the reception desk for more information.
5.2 Parents, teachers and other supervisors are responsible for and accountable for the behaviour of their (supervised) minors, individuals and groups at all times.
5.3 Photographs, videos and film recordings made in the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL may be used for commercial purposes only with the express written consent of the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL, in which event an applicable rate list will be applied.
6. REFUNDS
6.1 The following circumstances will never lead to any obligation on the part of the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL to provide a refund or pay damages to a visitor:
a. objects in the permanent collection of the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL not being visible;
b. the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL being partially closed, including, but not limited to, being partially closed due to the setting-up or dismantling of exhibitions;
c. nuisance or inconvenience caused by other visitors, including, but not limited to, noise, inappropriate behaviour (including molestation) and theft;
d. damage caused by other visitors;
e. nuisance or inconvenience caused by maintenance work, including, but not limited to, renovations or refurbishment of rooms;
f. nuisance or inconvenience caused by malfunctions in the facilities of the Frans Hals Museum (Groot Heiligland) or the Frans Hals Museum, Location HAL.
7. LIABILITY
7.1 The Stichting Frans Hals Museum is liable for damage a visitor incurs only if it is a direct result of gross negligence or intent on the part of the Stichting Frans Hals Museum,
in one or other of the following amounts:
a. up to a maximum of the amount paid out by the Stichting Frans Hals Museum’s insurer to the Stichting Frans Hals Museum in compensation for the damage;
b. the compensation paid out by a third party to the Stichting Frans Hals Museum for that damage.
7.2 In the event of damage in the form of death or physical injury, the total liability of the Stichting Frans Hals Museum will never exceed the damage amounts set out in paragraph 7.1.
7.3 Liability on the part of the Stichting Frans Hals Museum for indirect damage, including consequential damage, lost profits, wages, missed savings, etc., is excluded at all times.
7.4 The Stichting Frans Hals Museum is never liable for any direct or indirect damage, incurred as a direct or indirect result of any defect, characteristic or circumstance in or on any property of which the Stichting Frans Hals Museum is holder, (hereditary) tenant, lessee or owner, or which is otherwise at the disposal of the Stichting Frans Hals Museum, except if and insofar as the damage is the direct result of the wilful intent or gross negligence of the Stichting Frans Hals Museum and/or its employees.
7.5 If the Stichting Frans Hals Museum takes receipt of goods or if goods are deposited, held in storage and/or left behind anywhere in any way and by whomever without the Stichting Frans Hals Museum stipulating a fee for such deposit or storage, the Stichting Frans Hals Museum can never be held liable for any damage to or in connection with goods that arises in any manner unless the Stichting Frans Hals Museum deliberately causes this damage, or the damage can be attributed to gross negligence on the part of the Stichting Frans Hals Museum.
8. FORCE MAJEURE
8.1 Force majeure for Stichting Frans Hals Museum, which means that any damage caused by this cannot be ascribed to Stichting Frans Hals Museum, means any foreseeable or unforeseeable circumstance that interferes with performance of the agreement by Stichting Frans Hals Museum to such an extent that performance of the agreement becomes temporarily or permanently impossible or detrimental.
8.2 Such circumstances include, but are not limited to, circumstances involving persons and/or services and/or institutions that Stichting Frans Hals Museum is planning to use to perform the visiting agreement, everything that applies to such persons and/or services and/or institutions in terms of force majeure or reasons for postponement, and culpable deficiency on their part.
9. LOST AND FOUND
9.1 Items found in the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL by visitors may be handed over at the reception desks or to employees at the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL.
9.2 The Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL will place found items in storage and, in case of valuables, turn them over to the Haarlem police.
9.3 When a supposed owner contacts the museum, they have the option to pick up the items themselves or to have them delivered via cash-on-delivery. In either case, the owner must be able to properly identify themselves. In the event of doubt on the part of Stichting Frans Hals Museum concerning the status of the supposed owner, Stichting Frans Hals Museum is entitled to require proof of ownership.
10. COMPLAINTS PROCEDURE
10.1 Stichting Frans Hals Museum will make every effort to ensure the visit to the museum complex or the exhibitions and activities organised by Stichting Frans Hals Museum takes place according to the published offer; this includes the obligation to inform the public as clearly as possible on complete, partial or early closure of the museum complex or exhibitions organised by Stichting Frans Hals Museum. The visitor cannot derive any right to compensation in the event of such partial or early closure.
10.1 Visitors may register complaints by filling in a specific form, available at the reception desk at the Frans Hals Museum (Groot Heiligland) and the Frans Hals Museum, Location HAL, or by sending an email to info@franshalsmuseum.nl.
10.2 The complaint will be investigated and a written response will be given within 30 days. If the investigation is not complete at such time, the complainant will be informed of this and given an estimated completion date.
10.3 Complaints concerning the agreement between the visitor and Stichting Frans Hals Museum and requests for reimbursement must be received in writing by Stichting Frans Hals Museum within six weeks of the visit. Complaints and requests for redress submitted after this period will not be processed. A complaints form is available for these Visitor Terms and Conditions.
11. OTHER TERMS AND CONDITIONS AND APPLICABLE LAW
11.1 The applicability of these Visitor Terms and Conditions will not affect the possible applicability of other contractual terms and/or regulations of the Stichting Frans Hals Museum.
11.2 These Visitor Terms and Conditions and the agreement between the visitor and Stichting Frans Hals Museum are subject to Dutch law. Disputes arising from the agreement between the visitor and the Stichting Frans Hals Museum will be referred to the competent court in Haarlem, the Netherlands.
